Judge Suspends Armed Force Gay Policy

Federal Judge Virginia A. Phillips issued an injunction against use of the “don’t ask, don’t tell” policy in the armed forces on grounds it violated free speech and due process of individuals who were subject to being dismissed. She ordered the Pentagon to “suspend and discontinue any investigation, or discharge, separation or other proceeding” under this policy which harms the rights of gay and lesbian members of the military. The Defense Department said it was in consultation with the Justice Department on this issue.

Ironically, Judge Phillips was responding to a request by Log Cabin Republicans who oppose the ban on gays and lesbians. Judge Phillips made clear this policy has a “direct and deletorious effect” on recruiting rather than in any way impair the effectiveness of our military forces.

Common sense has finally triumphed.
