Military Or Civlian Trial Is Question?

Federal Judge Thomas Russell confronted a sticky issue and denied the application of an Iraqi national who is charged in Kentucky with planting roadside bombs in Iraq. Waas Ramadan Alwan argues that since the alleged crime occurred in Iraq that should be the venue for the trial. Alwan was indicted in Bowling Green on charges that he engage in conspiracy to commit the murder of US nationals in Iraq.

The United States has signed international agreements which state civilians in Iraq were subject to prosecution only under local law or through military tribunals. Frankly, this makes no sense. Why not have him tried under US Military law?
