For the first time, President Obama indicated there is a possibility that Bush administration officials who authorized torture might be subject to prosecution. He made clear that members of the military who were carrying out orders they assumed were legal would not be prosecuted, but “with respect to those who formulated those legal decisions, I would say that that is going to be more of a decision for the attorney general within the parameters of various laws, and I don’t want to prejudge that.” His turnaround came after many in Congress expressed dismay at his refusal to have that body conduct an investigation. However, the president emphasized whatever was done in Congress should be bipartisan in order to avoid claims his administration was out to get Republicans.
